3. How We Use Your Information
We use the information you provide strictly for the following purposes:
- Reviewing and responding to creator applications
- Sending campaign updates, announcements, and community communications
- Notifying you of Las Vegas events, activations, and creator opportunities
- Building and managing the PST creator and fan community
- Responding to messages submitted through our contact form
- Improving our campaign operations and outreach
We will not use your information for any purpose other than those listed above without obtaining your separate, explicit consent. We will not use your data for automated decision-making or profiling that produces legal or similarly significant effects.
4. Email Communications and CAN-SPAM Compliance
All commercial email communications from Poker Summer Takeover comply with the United States CAN-SPAM Act. Specifically:
- Every commercial email we send will clearly identify itself as coming from Poker Summer Takeover
- Every email will include a clear and functioning unsubscribe mechanism
- We will process all unsubscribe requests within 10 business days as required by law
- We will not send commercial emails to anyone who has unsubscribed
- Our physical mailing address or a valid P.O. Box will be included in commercial emails

5. Where Your Data Is Stored
Form submissions are transmitted over encrypted HTTPS connections and stored in Google Sheets via Google Apps Script, hosted on Google LLC's cloud infrastructure in the United States. Google acts as a data processor on our behalf. Google's privacy policy and data processing terms apply to data stored on their platform and are available at policies.google.com/privacy.
Access to submission data is restricted to authorized members of the Poker Summer Takeover team only. We do not grant third-party access to your personal data except as described in Section 7 below.
6. Data Retention
We retain personal data for the following periods:
- Creator applications (not selected): 24 months from submission, after which data is deleted or anonymized
- Creator applications (selected participants): Duration of campaign participation plus 36 months for legal and contractual record-keeping purposes
- Fan and supporter signups: Until you unsubscribe or request deletion
- Contact form messages: 12 months from submission
After the applicable retention period, data will be permanently deleted or irreversibly anonymized. You may request earlier deletion at any time as described in Section 9.
7. Data Sharing and Third-Party Disclosure
We do not sell, rent, trade, or share your personal information with third parties for their marketing purposes under any circumstances.
We may share your information only in the following limited circumstances:
- Service providers: Third-party vendors who assist in operating our campaign (such as Google for data storage) under written data processing agreements that prohibit them from using your data for any other purpose
- Brand partners (creators only, with consent): If you are selected as a creator, we may share relevant profile information with campaign brand partners as part of the collaboration. This will be disclosed and agreed to in your Creator Agreement before any such sharing occurs
- Legal compliance: When required by law, court order, or valid legal process, or to protect the rights, property, or safety of PST, our community, or others
- Business transfer: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the successor entity, which will be required to honor the commitments in this policy

We do not use advertising networks, retargeting pixels, social media tracking pixels, or any behavioral analytics tools.
9. Your Rights
Regardless of where you are located, you have the following rights with respect to your personal data:

- Deletion: Request deletion of your personal data ("right to be forgotten")
- Restriction: Request that we limit processing of your data while a dispute is resolved

California Residents — CCPA Rights

You have the right to know what personal information we collect, use, disclose, and sell (we do not sell personal information). You have the right to delete your personal information and to opt out of any sale of personal information (which we do not conduct). European and UK Residents — GDPR Rights
If you are located in the European Economic Area (EEA) or the United Kingdom, you have rights under the General Data Protection Regulation (GDPR) or UK GDPR, including those listed above. The legal basis for our processing of your data is your consent, which you provide by voluntarily submitting a form on our site. You have the right to lodge a complaint with your local supervisory authority if you believe your rights have been violated. By submitting a form, you consent to the transfer of your data to the United States, where data protection laws may differ from those in your jurisdiction.
10. Data Security
We implement reasonable technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. 11. Data Breach Notification
In the event of a data breach that is reasonably likely to result in harm to affected individuals, we will notify affected users without undue delay and no later than 72 hours after becoming aware of the breach where required by applicable law, including Nevada Revised Statutes Section 603A and applicable federal law. Notification will be provided via email to the address you provided at signup.
12. Cookies and Tracking
This site does not use tracking cookies, advertising cookies, or any persistent identifiers that track your behavior across sites. We do not operate retargeting campaigns, social login tracking, or any behavioral advertising infrastructure. Standard server logs may record IP addresses and access times as a function of web hosting, consistent with InMotion Hosting's standard practices.
13. Children's Privacy
This site is intended for individuals 18 years of age and older. We do not knowingly collect, solicit, or maintain personal information from anyone under the age of 18. If we become aware that a person under 18 has submitted personal information to us, we will delete that information promptly. 14. International Users and Jurisdiction
This site is operated from the United States. If you access it from outside the United States, your information will be transferred to, stored, and processed in the United States. By submitting a form, you consent to this transfer. We make no representations that this site or its content is appropriate or available in all jurisdictions, and users in restricted jurisdictions access it at their own risk.
15. Changes to This Policy
We may update this Privacy Policy as our operations evolve. Material changes will be indicated by an updated version number and effective date at the top of this page. For significant changes, we will make reasonable efforts to notify affected users via email. Continued use of the site after the effective date of any changes constitutes acceptance of the updated policy.
